Terms of sale (draft)

Seller

The seller is Motor Cover Ltd, trading as Motor X Checks, a company registered in England and Wales, company number 16618093. ICO registration number ZC280666. Motor Cover Ltd is not VAT registered. Prices include no VAT. Registered office: 78a Upper Aughton Road, Southport, England, PR8 5NJ. Complaints and questions: info@motorxchecks.co.uk. There is no phone line on this site.

What you are buying

A vehicle check is digital content. It is a report about one registration, supplied on screen or to the email address you give. The products and prices, when purchasing is switched on, are Factory X Extras £4.49, Service X History £5.99 and Provenance X Check £8.99. MOT history on the public check page is free and is not a paid product. Prices are the amount you pay for that check. This draft does not add a separate card fee.

The data comes from third parties, including the DVSA for MOT history and other vehicle-data suppliers for the paid checks. A report is only as complete as the record those suppliers hold. It is not a physical inspection and it is not a promise that a car is roadworthy.

When the check starts

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, a consumer buying digital content at a distance normally has 14 days to cancel. For digital content that is not supplied on a disc or other tangible medium, that cancellation right can be lost once supply starts, but only if the consumer has given express prior consent for immediate supply and has acknowledged that the cancellation right will then be lost.

This draft is written so that a paid check starts as soon as payment is taken, because that is when the lookup runs. Before this page is used, the solicitor must approve a consent step that asks for that immediate supply and for the acknowledgement that the 14-day cancellation right is waived for that check. Until that consent step exists and is approved, these terms must not be presented as agreed.

Refunds

The refund rules are in the refund policy (draft). In short: Factory X Extras and Service X History are refunded in full when no data is found. A paid check that fails for a technical reason is refunded in full. Provenance X Check is charged when the check runs, including when no record is found, and is refunded only if the check fails.

Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, or any other liability that the law of England and Wales does not allow us to limit or exclude. Subject to that, liability for a check is limited to the amount paid for that check. We are not liable for a decision you make about a vehicle, or for a gap or error in a third-party record, beyond that amount.

Email info@motorxchecks.co.uk. We aim to acknowledge a complaint within 5 working days and respond within 14 days. If you remain unhappy about how we used personal information, you can contact the Information Commissioner’s Office. ICO registration number ZC280666.
